Workers' Compensation is a system of benefits provided by law for workers who have job-related injuries or illnesses. Benefits are paid for injuries or illnesses that were caused by an employee's work. The District of Columbia's Office of Risk Management self-administers all Public Sector Workers' Compensation claims. Who's Covered. The Massachusetts workers’ compensation law, MGL c. , § 1(4), states that an employee is “every person in the service of another under any contract of hire, express or implied, oral or written.” Exceptions include but are not limited to: Seaman engaged in interstate/foreign commerce; Salesmen of real estate or consumer goods who work on a commission, or buy/sell basis other than in a.

In New Jersey, failure to carry workers' comp is considered a criminal offense punishable by a fine of $10, or imprisonment for up to 18 months. Check with your state or your attorney to make sure you are classifying workers properly and, if required, purchase workers' compensation insurance to avoid these costly penalties. § Workers' Comp. General Provisions § Designation as Independent Contractor § Workers' Comp. Court § Workers' Compensation – State and Municipal Employees § State Employees' Compensation Fund § Workers' Compensation – Report of Injuries § Workers' Compensation – Benefits.

However, if you cover your workers compensation claims through a program of self-insurance then the relationship between bankruptcy and workers compensation becomes much more complex. If an employer files for Chapter 7 bankruptcy, the employer will be liquidated and the self-insurance program ends. (There is no further need for the workers comp insurance as the . compensation laws establish this liability as well as the benefits of the injured worker. Generally, any employer who hires at least one employee, part-time or full-time, is required to provide workers’ compensation coverage. Employer’s requirements may be met by purchasing a policy from an insurance company for workers’ compensation.
